    In Manhattan on Monday a court watcher asked the ADA for his name, to which he replied: “ask our press office.” How can you claim to represent the ‘People’ but refuse to speak to the People?

    Reflection from a court watcher after 6 hours observing arraignments: "After doing two shifts in Manhattan I'm seeing largely what I expected (nuisance cases, wasted taxpayer money, ADA & judicial incompetence, and above all blatant racism)."

    In January, Judge Iannece lost his temper when he was unable to put defendants behind bars. He yelled at one baby-faced 28-year-old with other pending charges, “If I see you again, I don’t care what anybody says. We’ll keep you.”

    Our organizers spoke to 30 people today at criminal courts in NYC. In addition to speaking with people who are now out & coming back to court, they spoke to 10 people who were there to support loved ones who were incarcerated pre-trial. Jail impacts the entire family.

    I can't stop thinking abt an arraignment I watched Friday night - a young mother before court charged w/ a non bail eligible offense, she had a warrant for a failure to complete community service on an older case. Supervised release stood next to her, the judge ordered REMAND

    What happened to “least restrictive means” when this person was accepted by supervised release? What about “ability to pay” considerations or “ability to post bail without posing undue hardship?”

    Judge Espinosa set $5k cash, $10k bond & $10k partially secured bond only citing to warrant history with no details or other explanation. At the end of her decision, Judge Espinosa made a comment “if you do somehow make bail...” to which the accused stated “I won’t, I won’t.”

    Also in Manhattan, ADA Roe requested $100k cash, $200k bond, $300k partially secured bond in a bail eligible offense. Legal Aid attorney argued that accused was born & raised in NYC, was screened & was qualified for supervised release & did not have ability to pay bail.

    This only, even arguably, applies to the older case which is not before the court. This is a DA trying to do whatever he can get away with rather than what's right and legal

    However, Judge Espinal released these individuals, stating that the statute does not allow bail in those instances. Judge Espinal is right and ADA Greenberg should be ashamed in his unlawful attempt to expand the statue.

    ADA Greenberg argued that because a complaint had been filed, there was “clear & convincing evidence that a new crime had occurred” and therefore bail was warranted.
