Kleine said he personally will petition for the grand jury and special prosecutor. Several people had discussed petitioning under a state law to require a grand jury. Kleine said he only would rarely do this.

Kleine said he will file a petition with the presiding judge tomorrow morning. “I would think it’s going to be awhile” because of Covid and other concerns.

Kleine said additional evidence has come in — some of which has enhanced his decision to not charge. But it’ll be up to a grand jury to decide if the evidence merits charges. He welcomes more evidence.
