First, Boudin’s policy, like Gascon’s, is not to charge “strikes” or certain enhancements. When McAllister was charged in 2015, he should have been facing 35 years to life. Robbery: 5 yrs 2 strikes (robbery & carjacking): 25 to life Gun enhancement: 10 yrs But …pic.twitter.com/Wf9eW4GNAP

… McAllister’s plea deal allowed him to plea only to robbery for credit for time served: 5 years. Because of Boudin’s policy, his robbery sentence was NOT enhanced nor was the 10-yr gun enhancement imposed. Had his charges been enhanced, he would've been in prison on 12/31..

Second, Boudin’s claims of so-called “parole leverage” ring hollow. McAllister was arrested twice for auto burglary - a crime rampant in SF. There may have been 2 resd. burglaries as well. Given McAllister was a serial robber, he should have been charged with the crimes. ...

... It wasn’t SOP that prevented the charging, it was Boudin’s Office policy. Boudin does not believe the penalty for non-violent crimes -- no matter who commits them or how many times -- should be prison. That’s why McAllister was free to kill the two women.

Four days before their deaths, Boudin told 48hills, “We have been able to safely decarcerate; we don’t see jail or prison as the only or basic response to crime.”pic.twitter.com/Huc6DjtDx5

One day prior to the deaths of Abe and Platt, Boudin was asked by the BBC, "Is there any non-violent crime you think deserves a custodial sentence?" Boudin’s answer was ...

“In general? No. There are certainly exceptions though and each case is different. Jail and prison should be a last resort.” (Boudin, 12/30/2020) Apparently, McAllister burglaries and thefts did not meet Boudin’s criteria.pic.twitter.com/tZIjdLrbuu

Third, how did @GeorgeGascon let this guy sit in jail for 4 years without any action? How was he not already in prison for his 2015 robbery? McAllister benefited from DA fatigue. I’m sure his file was passed around to the point where no one cared. Add Boudin's policies ...

... and you get this sweet-heart deal last April. Lastly, it’s important to remember that McAllister bears ultimate responsibility for these deaths. It will be interesting to see if Boudin charges 2nd degree murder ’or, if he sticks with vehicular manslaughter charges, ...

... will Boudin add the 2 strikes. If it’s just vehicular. manslaughter, McAllister will be looking at a maximum of 14 yrs minus credits. (Don’t get me started how #Prop57 will benefit him.) @chesaboudin needs to stop deflecting, blaming others and own up to his responsibility.
