As an originalist matter a jury that has not been advised of its power to acquit against the evidence is no more a 6Am “jury” than one that’s been told it may not deliberate. So why aren’t modern juries so-advised? Because doing so would render coercive plea bargaining untenable.

When you allow people who wield the power of life and death over others to take short cuts that bypass carefully designed, long-standing (and yes, less efficient) processes, it’s imperative they have personal skin in the game. Here I’m thinking of prosecutors and plea bargaining.
