If this lawsuit goes forward, it may end up finding against CDL programs in general, something that publishers and authors' groups have long looked to abolish because they see it as competition with ebook sales.

And, if that happens, nearly every library in the US with a CDL program will be liable for infringement damages for having run their CDL programs, some of which have been running for more than a decade.

The damages for the emergency lending program would not only likely bankrupt the Internet Archive, but the precedent could also end up being a lever that publishers could use to exert control over (or simply bankrupt) almost every local library program.

There are many excellent points in that post that rest on a very shaky foundation of it being a defense of a billionaire’s privately operated site.

If you want to point out where I am defending any publisher’s actions, in place of denouncing harassment of an individual, I am more than happy to read it

Sure. The weird way you keep trying to imply some sort of malfeasance on the Internet Archive's part by calling it "a billionaire's private site", such as in your tweet immediately previous, as opposed to a library, which it is.

Billionaires can own libraries too. In fact, historically it’s very common. Didn’t stop them from some light piracy now and then either.

And again, since you seem absolutely determined to ignore this point - I have no issues with the IA and it sharing works it has the rights to. It’s a noble endeavor. Making it harder for marginalized authors to survive is not.

Neither is attacking someone for pointing that out, especially when they are not involved with the entities who are actually trying to get rid of the IA. Go yell at Disney all you want. I’ll back you to the hilt.
