Not really sure that rises to the legal definition of “assault”, but yeah, he didn’t respond appropriately. He should’ve constantly readjusted his knees by slamming then into the back of her seat while using the headrest to leverage his body around.

[puts on super pretentious asshole hat] Speaking as a lawyer... [takes off super pretentious asshole hat] It’s definitely assault. It’s probably not battery.

Legit question then - can the recliner be charged with assault if the seat is physically smashing someone’s knees when reclined?

Assault means you put someone in immediate fear of a battery. I don’t think reclining into someone’s knees qualifies unless she repeatedly drilled him in the knees as hard as possible.

Let me know if you’re interested in pursuing litigation. Or at least having me explain why rich retired athletes who stand approximately 6’9” should just pay for the damn upgrade.

Again, that’s the point though. Why is the financial burden always on the person who the discomfort is being applied to? “Pay more to avoid my cruelty.” Why isn’t the obligation on those who want to recline?

I’m not sure how that would work. If she paid more for the right to recline, that would only make her more likely to use it. I’m fine with airlines banning reclining in coach. That would be really popular and, frankly, the 6 inches of recline you get isn’t even more comfortable.

Sorry, I didn’t explain that enough (it’s basically what you suggested). Ban reclining in coach, if you want to recline pay more for the seats where you can do it without jacking someone up.

I’m all for that. Or just legislate that airlines can’t put the seats so close together that someone can’t recline without trapping the person behind them. That’s a safety hazard in addition to general obnoxiousness.

Lol at the idea we’re getting any legislation that’s not approving a Hitler Youth to a federal judgeship

Just add it as a rider on a bill to make eye jobs tax deductible and it’ll fly through.
