That motion was denied… judge deemed the circumstantial evidence "overwhelming" enough to obviate need for Ofshe.

Do you know how the assault charge works? Does it come in under felony murder-like provision (harm from fire) or freestanding?

It's like felony-murder, in that it's tied to the felony finding. Would be assault in the second degree (only a D felony) otherwise
