Supposed to be a guaranteed minimum of six years due to NYS sentencing provisions under “hate crime” statute given nature of offense. If charged w/ Assault 1st, sentence is 5-25, but I’d guess it’d be Assault 2 if injury concussion or less, 2-7 years, w/ minimum hate sentence.
