This will raise an interesting question of when, exactly, does one become a public figure. Sandmann will have a MUCH harder time winning a lawsuit if he is a public figure because the bar he must clear is "actual malice" /1
I'm not a lawyer, so take what I say for what it is worth. But I believe "Actual malice" means he must prove by a preponderance of the evidence that statements made about him were knowingly false or made with reckless disregard of the truth. /2
Obviously, when the video of him was first posted, he was a private figure--making a lawsuit against those who first reported on him easier. /3
But at some point he became a public figure, making lawsuits against those who published after he became a public figure almost impossible to win. So I expect this lawsuit will have to answer exactly when did he become a public figure. /4

If this guy and his team are doing all the work then why is Barnes making all the noise? I've seen McMurtry 0 times on TV but Barnes has been a permanent fixture on Fox and other conservative shows. So much attention grabbing. Really devalues the whole thing.
