Correct statement of law. Question is whether the facts fit.
The motion to dismiss won't succeed and the case will move to discovery. I predict a seven figure settlement. Otherwise Musk goes under oath in a deposition and has his life scrutinized in uncomfortable ways. I'm sure his lawyers have told him this already.
