Section on 'vexatious' requests seems to risk conflating dogged pursuit of information related to abuses of power with vexatious requests. Is this a change, or has it always been like that?

Concerned there's a desire to presume public bodies are doing their best to fulfil FOIA obligations, and that if there's prolonged conflict over a refusal to release info, this indicates requester is being 'vexatious'.
