Kavanaugh is not entitled to a presumption of innocence. The country is entitled to be assured that a rapist is not appointed to lifetime seat on the Supreme Court. A full investigation can help give that assurance. That is not too much to ask.

Are you being serious? Actually, he is, under every code of law that’s ever been written in this country and most others. An investigation is not at all too much to ask, I completely agree with that.

So in a legal proceeding, a “presumption of innocence” means the burden is on the accuser. However, in a case like this — essentially a job interview — the burden is rightly on him, not to prove his innocence necessarily, but to prove he is fit for the job. END

Dennis, I know what the presumption of innocence is. But what you’re saying is semi-crazy: I can run into your next job interview while you’re sitting there answering questions, tell your prospective employer that you’re a rapist, and the burden’s on *you* to prove you’re not?

Future cases where a Justice Kavanaugh is the fifth vote can become open to question. That is the first step toward the Court being discounted altogether. That way lies the road to perdition. Fin.

I can get on board with all of that, other than that it’s his job to prove himself innocent. Your best point is dead on: just like any other job, the employer has the right to ask questions, and if they are not satisfied with the answers, they don’t have to offer employment.

And just one other point: that employer is us, not the SJC. The Committee has an obligation to run this all the way down, given the stakes. Right now, I don’t think the majority is fulfilling that obligation, not even close.
