You're right. That said, the fact that the FBI has chosen not to investigate is a pretty good justification for dismissing the validity of the allegation.

Or the fact that it allegedly happened in high school and nothing sexual actually happened. Not even a forced kiss. There are plenty of legitimate reasons to dismiss the allegation. What Diane Fienstein dod with the letter isn't one of them.

That was one thing that made it really weird to me. They were trying to use the 'incident' to paint him as some horrible sexual predator, but they had to go back at least 35 years, to when he was probably a minor and the records if any actual incidents would likely be sealed?

Full disclosure: I'm a liberal and I oppose Kavanaugh's appointment. That said, I find the allegation too thin as a basis to disqualify him. We all did questionable things in high school, and this allegation is nowhere near attempted rape.

If they want to use this as an excuse to delay the confirmation and investigate further, fine. But I find all the smearing like he's some sexual monster rather distasteful.

An allegation with no evidence about a groping that no one else has corroborated is now evidence to not appoint people? No one will ever be appointed to the SCOTUS ever again if this is the standard.
