Yes, the climber assumed the risk that he would fall... but not that the Sheriff’s Dept would be negligent in rescuing him

Negligent? I grew up near Mt Hood and had many friends on search and rescue teams there. This is a ridiculous charge. Lives have been lost trying to save people who climbed in dangerous weather conditions; one person’s bad judgment shouldn’t lead to more deaths.

You are packing a lot of facts in there that may or may not apply to this case. What we do know is that the Sheriff’s Dept has a statutory duty which it is alleged to have breached. That’s what lawsuits and juries are for.

The Sheriff’s dept, the Mazamas and the military deal with this every year, way more than they should. Just because you got yourself into a dangerous situation, doesn’t mean that others are required to suspend judgment and risk their lives needlessly 2 rescue you.

I don’t disagree. But we don’t know that “dangerous conditions” was the reason for the delay. Again: that’s why we have courts and juries. If the case is a weak as you think it is, it will be knocked out early with a motion to dismiss.

I feel for the family, tragic loss. Blame cannot be placed on rescue teams though. The inherent danger negates fault.

Mountain climbing is a risky business maybe everyone who will climb should sign a waiver that they’re willingly doing it at their own risk. Taxpayers money shouldn’t be involved when city or county gets sued.

No it is the climer's fault, if he hadn't gone up the mountain, he would still be alive. He decided to put his life at risk by trying to climb the mountain, it is not the emergency services fault that he got into difficulty and needed their help
