He wasn’t operating a motor vehicle, so what’s the deal? It seems like a rather novel solution to transportation while under the influence. He could be ticketed for being on the freeway outside of a vehicle (just like when someone walks there), but a DUI?

In CA you can get a DUI riding a skateboard so this seems reasonable

I can’t find the legal definition of a vehicle. It appears to cover bikes, farm equipment, even skateboards and horse-drawn carriages, but I’m unclear on animals only.

Good point. I’d assume there’s some statute that qualifies anything that moves a person from one point to another as a form of transportation and therefore subject to a DUI. In any case it’s ridiculous
