On one hand she should have told the employer that she would be going on leave during the interview. On the other, firing her over text is incredibly bad. At least let her explain to you face to face, maybe even work something out.

On all the hands, you cannot be discriminated against for employment purposes based on pregnancy.
-
She didn't disclose important information to the employer. It's like waiting until getting the job and then telling management you can only work mornings. No. You were hired for something and if you cannot fulfil that purpose, you will be let go.
-
It’s illegal for them to not hire her b/c of pregnancy. It’s also illegal for them to ask her about it in an interview. I don’t know about the specific state laws in Washington, but in my state it’s also illegal to fire someone for pregnancy, even if they are not FMLA eligible.

Hope they’re prepared for a lawsuit and giving her far more than you would ever have thought. Aren’t employees trained anymore.

Employers have been doing this crap for years and you know it - why are you just now saying something about it?
-
Yes this has been going on for years... except this case was IN WRITING so it makes a difference in my experience

@jerseymikes have an HR department that teaches what not to do in these situations? -
Thank you for reaching out. Jersey Mike’s Subs shops are locally owned and operated. The local franchisee is addressing the situation.

Your attorneys should be advising you on how to manage your reputation risk. Your response indicates you are clueless RE your corporate duties in managing your reputation through standards implemented through your locally owned/operated stores. 50% of the customer base is female.

Even if it was a mistake made out of naivety, you'd think they'd have better PR statements than, "It's a franchised store, so..."

WTH? Obviously,
#JerseyMikes doesn't know this is illegal! Let's hope the woman gets a BIG payout and doesn't have to worry about going back to that sexist company, once her maternity leave ends! - 1 more reply

Wow,
@jerseymikes you dont train your managers about labor laws? Or ethics? Are you firing this person? -
Wow
@SeattleSunshin1 you don’t actually read the articles? You just look at the pictures? Very clear that the manager resigned and the CEO of the company commented this shouldn’t have happened. -
Nope. Just saw the text. Usually read things i comment on. My bad
