      Not sure, but does paragraph c not temper that view slightly, when the effect on public confidence stems from conduct which relates to professional performance? Seems to read that way.

      Its not written very well but its actually saying a court should be reluctant to depart from a tribunal where the issue relates to professional performance - which was the central issue to #BawaGarba

      I see what you mean now I read it again. 'More readily depart from' is an interesting phrase though. Suggests the court can depart in either circumstance imho, but that one requires more justification than the other.
