Quite. Perhaps we need to be more willing to deploy it and test it through courts. Which isn’t ideal.

IMHO DoC would be a requirement to ensure learning and justice & would not be an immunity to consequences. Consequences would become more severe or criminal if DoC is not followed. In fact, failure to be honest even if no failure of care are found should still be prosecuted.

I've always thought immediate apology, total honesty and inclusion in investigation would be less likely to end up in any sanction at all.

MDU recommends that doctors apologise for mistakes. Unfortunately in serious cases Hospitals and lawyers advise doctors to not speak with family. Of course apologising also requires doctors to admit that they made mistakes in the first place. Not easy if ego/hubris was a factor.

Maybe the legal team advising professionals should be representing the public i.e. work honestly in the public interest. On neither side but giving best honest advice. The health service is a national organisation. Does it not ultimately belong to the public? Maybe I'm too naive.

I think all signs continue to point towards the need for an national independent investigation authority for all healthcare serious incidents. SUIs and coronial investigations are not fit for purpose.

Jury is still out for me. It has been nearly a year and they haven't provided a final report for any investigation yet. I don't think they got up to 30 either. Maybe they're all stuck in the safe space. :/.
