      This does not appear to be a review of gross negligence manslaughter, but of how to explain the law to doctors. Since juries decide whether negligence is "gross" ( "truly exceptionally bad") there can be no exhaustive list of what constitutes gross negligence and what does not.

      I suspect there is little that can be done about the law and that this is more about the threshold for bringing prosecutions in healthcare settings.

      The CPS's policy governing whether to prosecute for "medical manslaughter" is in my view at the heart of the matter. However, surely that is not a question for the Department of Health and Social Care to determine?

      No, surely not. This review is making some long term complainants very uncomfortable. The law is our safety net for when medical self-regulation fails us (and it commonly does). Does Hunt even have a transcript of the original trial with which to determine this is necessary?

      No. On the contrary in fact. But what I am saying is that people Iike you should stop describing gross negligent manslaughter as mere 'unintended errors of clinical judgement' without a trial transcript to hand. That's a clinical negligence case. This criminal bar is far higher.

          I have. I've been heavily exposed to the clinician narrative on this case & from that it could be easy to feel sympathy for her. I'll reserve judgement until I've seen a transcript, but her treatment on arrest is utterly outrageous. The confidence you mention is not one I share.
