Not used in most recent case First criminal case = fault lay with
#BawaGarba alone. MPTS found systemic failings played a part = reduced 'penalty' The final case answered the question 'Can the MPTS ignore first case ruling' Not clear role reflections played in first 2 cases. -
#BawaGarba is all round tragedy for everyone. No junior should be put in the position she was. But she also did some mistakes. Jury found her guilty. Personally I am absolutely convinced this is a case of#Corporate Manslaughter. -
Agreed.
#bawagarba actions fell below par and this should have repercussions. Scapegoating her means the greater crime is unpunished. Senior Drs actions not scrutinised to same degree. Systemic failings yet no case of corporate manslaughter. That's the true rub.

There have been at least two cases to my knowledge where reflections have been used by the prosecution. Probably more. The point is broader. Should reflections be privileged? They are in the airline industry. It has strong record on learning from errors.
