Annoyed that I’m reading a book about the MCA which says ‘if the MHA is invoked, it’s provisions trump those of the MCA’. Aargh. Just - is it any wonder ppl in MH settings become dismissive of MCA. ‘Trump’ no, it’s not a card game of human rights.

Can I ask, is the author legally qualified or medically qualified or neither (or both)?

It is a book (sigh) published by the Royal College of Psychiatrists and the person who wrote the bit I quoted is a professor of psychiatry. More sigh

I’m going to rip it to shreds in my essay :( but I don’t think many psychiatrists (or indeed, many people!) will read it. Maybe I’ll do a blogpost

It’s just such a dangerous way of thinking. I know why he’s saying it but ppl (doctors) read it as meaning ‘we don’t need to worry about mental capacity because this person is detained’

And even when you CAN force treatment, it doesn’t mean you can or should just ignore the MCA...

The more I hear people talk about this subject, the more compelled I feel to learn about it. Seems to be a focal point for abuse of power.
