well, my initial thoughts were what about any settlement which has to be lodged with the court and could be matter of legit public interest (but arguments not made in open court)

hard to say. Many NHS/private company settlements are "confidential" which leaves journos unable to scrutinise them. Would a judge accept they ought to be open to scrutiny?
That's a very good question. I look forward to somebody testing it out. So this isn't a case of journos observing court cases but being prohibited from reporting them? They're closed sessions?
it's more cases which are started in the courts but a settlement is then reached out of court so there is no court proceedings or judgement to report eg Virgin/Surrey CCGs.
