hard to say. Many NHS/private company settlements are "confidential" which leaves journos unable to scrutinise them. Would a judge accept they ought to be open to scrutiny?
That's a very good question. I look forward to somebody testing it out. So this isn't a case of journos observing court cases but being prohibited from reporting them? They're closed sessions?
it's more cases which are started in the courts but a settlement is then reached out of court so there is no court proceedings or judgement to report eg Virgin/Surrey CCGs.
