John, the Health Select Committee recommended a statutory Duty of Candour more than a decade before Mid Staffs. The inquiry was set up as a consequence of Robbie's perverse 1997 Court of Appeal ruling that doctors had no legal duty to tell the truth after a child's neg death!pic.twitter.com/8ZVT5ZI9mB

Although my request to give evidence to the Mid Staffs inquiry was refused Sir Robert Francis referred to Robbie's case in Mid Staffs report. Problem was he misreprented Robbie's ECtHR's ruling. I've written to him & asked for an explanation but he has so far failed to respond!

Francis hasn't turned out to be the shining knight we all hoped for, eh? Recommendations seemed fairly robust at the time, but he's faded into the background almost as fast as his key recommendations have.

John, the absence of a legal Duty of Candour was first exposed by Robbie's case at the High Court in Cardiff in 1996. John, there is still no legal duty for doctors to tell the truth to bereaved parents/families. Legal duty of candour is owed by NHS employers who can't provide truth to families unless doctors disclose the truth to them & CQC can't take action if the Trust didn't know the truth!
