By “prosecution” I presume you also mean GMC/NMC sanctions too? Otherwise fear of sanction will remain.

My thinking when I wrote it was regarding criminal prosecutions, Jim. I'm open to hearing all views on how professional regulation should sit alongside it though. It's all part of the culture.

Prosecution is the very tip of the iceberg. Most of us worry about “being in front of the GMC” for a mistake. Prosecution not really on the radar.

It's strange, but the GMC seem to have pulled off the impossible - managing to exasperate, infuriate & upset both clinicians and patients/families alike with their stance. Feels like a change is needed somewhere.

Good start, I agree. Doesn't matter how many times you say it, paid for by doctors, run by doctors, judging other doctors... never sounds any better. I'm sure many will dispute & defend it, but that's the external perception. And then a few poor sods get nailed to hit stats.

Any regulator needs “insiders” to ensure adequate understanding of the issues, obviously. But maybe on a “co-opting real staff” basis like CQC

That's an important point. And it's one that always leads to the question of independence. So many investigations have proven to be compromised in the past, it'll need to be nailed down. Along with the medical evidence being secured instantly. Plenty of peripheral issues here.
