A powerful, important read from @deb_cohen http://www.bmj.com/content/359/bmj.j5534 … its hard not to think the @gmcuk and the courts have got this very seriously wrong...

By “prosecution” I presume you also mean GMC/NMC sanctions too? Otherwise fear of sanction will remain.
-
My thinking when I wrote it was regarding criminal prosecutions, Jim. I'm open to hearing all views on how professional regulation should sit alongside it though. It's all part of the culture.
-
Prosecution is the very tip of the iceberg. Most of us worry about “being in front of the GMC” for a mistake. Prosecution not really on the radar.
-
It's strange, but the GMC seem to have pulled off the impossible - managing to exasperate, infuriate & upset both clinicians and patients/families alike with their stance. Feels like a change is needed somewhere.
-
Nail. Head. Making it publicly funded might at least resolve some of the distrust/dissatisfaction.
-
Good start, I agree. Doesn't matter how many times you say it, paid for by doctors, run by doctors, judging other doctors... never sounds any better. I'm sure many will dispute & defend it, but that's the external perception. And then a few poor sods get nailed to hit stats.
-
Exactly. Public don’t trust it. Doctors don’t either. And doctors resent having to pay for something they see as being “out to get them”.
-
Sounds a lot like the atmosphere in every regulated environment I've ever encountered tbh. Resentment is almost a natural inevitability, but especially so when regulatory credibility is lacking.

Something similar has been enacted in Italy, but with references to following ‘best practices’ which probably reduces the scope to very simple slips.

Is that right? Interesting, thanks Steven. You wouldn't know of any English language info on that one I might be able to look at, would you please? Thanks...

ZHH Does Clause 1 Health+Social Care (Safety+Quality) Act help here? Designed to protect patients + professionals
-
Not sure Ken, tbh. I'd need to go back over it and consider that (it's been a while since I looked). Thanks for the prompt to do so though...
