Exactly. This smacks of pre-judging the Bolam test to me. Like it isn't already sufficiently biased in favour medical 'perceived wisdom'? Science, it ain't!

It certainly gives patients/families an extra factor to argue if it doesn’t apply. Would an independent expert carry at weight at all?

I have no idea tbh. But it's already a massive challenge to argue against the 'reasonable body of medical opinion' definition. Can't see this making it anything but harder. Maybe even impossible? Genuinely concerning.

Clinicians can just circumvent the Montgomery judgement using the existing consent form scam, so I doubt it tbh. This has potential to be of much more wide-reaching concern than the non-disclosure of medical risks, imho.
