      My complaint was “upheld” & I got an apology. But the “professional” I complained about suffered no consequences, is still practising, & I definitely feel that I am the one being penalised.

      You actually did very well to have your complaint upheld and secure an apology. I appreciate it probably doesn't feel like much of a win, but take heart from knowing you've achieved more than most. Lack of individual accountability is a hot topic, I'm afraid.

      I'm up to over 7 years now (and I'm a relative newbie). I did go to the ombudsman. And the GMC, NHSE, CQC, DoH, Healthwatch, Patients Association, police etc and finally, even the newspapers.       Is it hopeless? Is our best route just to suck up to the ghastly clinicians who behave like this to try and protect ourselves from worse care?

      The standard of my family's medical consultations has improved no end since I had cause to learn the law surrounding consent tbh. Everybody should learn the basics, imho. Nature/Purpose/Risk. Amazing how the dynamic shifts once a clinician realises you know your consent onions.

      That's a really good question actually. Worthy of more than just a few tweets in reply, but I don't know of any 1 place I can refer you which would cover all that grabbed my attention either. Was planning on starting a blog soon, so perhaps I should cover that? As bullet points:

      - Understanding the difference between consent & informed consent (criminal vs civil) - Appreciating consent happens in consultation, not on the form (and why) - Appreciating that despite that fact, the form is commonly taken as 'proof' of consent by the courts anyway.

          - Understanding the right & importance of recording every consultation in order to have an accurate record of the consenting process - Recognising that you should be offered ALL treatment options that are deemed to be 'of overall benefit to the patient', no matter how marginal.

          - Recognising that what is regarded as being of overall benefit (and what is not) is often merely an opinion - and opinions can vary. So check what wasn't offered and why not. That's a few thoughts off the top of my head, but guess I need to start that blog really?! :)
