That significant systemic issues & responsibility of others were covered at trial, (even if there was a limit as to how far they could be explored), is a point which becomes apparent when looking at #BawaGarba's defence summary from the Court of Appeal judgement. 4/pic.twitter.com/HVpaQnnEZ5

Point 2: "Dr #BawaGarba is no criminal" Err...yes, she is a criminal. You have a profile picture with your arm around a convicted criminal. Fact. Here's the court of appeal judgement refusing her leave to appeal her conviction, in case you've forgotten: 5/ http://www.bailii.org/ew/cases/EWCA/Crim/2016/1841.html …

Point 3: "We won #Sellu but my view is losing an appeal does not confirm guilt." What does confirm guilt then? Are you also of the view that winning an appeal does not confirm innocence? Meaning Sellu isn't in the clear? Can't have it both ways, try as you might. Same judge! 6/

You shamelessly misdirect readers on the facts of this case imho, in order to attempt to influence opinion and gain support for reforms which are designed to secure unjustified extra protections for doctors. I've had enough of it, frankly. #BawaGarba #BawaGarbage 8/8

Anybody can change my mind if they present me with evidence to demonstrate why I should do so, Umesh. I'm open minded. What I believe is that nobody has put an evidenced argument together which demonstrates that her conviction is unjustified. Despite impressions to the contrary.

I think it’s hard to say that the systemic failings were considered. All you can really say is that the systemic failings presented to, and available to the court, were considered. Not the same thing

I don't think anyone can say anything for sure without the trial transcript (I'm looking at you again here, @drcmday). It's important to be clear the jury (not just the court) heard such evidence, but otherwise I wouldn't disagree. Do you think something was left out? Why, if so?

Didn’t talk to any of the trainees on the unit: hard to see how a clear picture of “normal for that unit” could have taken place without that; wider reports into quality of training can much later

Ok, but if the jury got to hear what 'exceptionally challenging circumstances for that unit' were like on the day in question, then does that not better serve her defence than a more general picture of normality?

Not sure: things like showing a consultant an abnormal blood result and having that ignored. I learnt pretty quickly that if you challenged that or pushed for a response, you could get taken to pieces. Public humiliation. That’s a cultural issue

I must say, that's the one aspect of this sorry tale where I sympathise with her position. Whatever capability is expected of her, it's only fair the consultant demonstrate the same. Looking at the appeal grounds for BG, did he escape because he arrived after point of no return?

At trial Dr BG just needs to raise doubt. But anything she claimed becomes open to the prosecution to disprove. Likely explains the complete absence of the numerous claims about how busy she was saving others.

I'm assuming a lumbar puncture is routine for a year 6 in acute paediatrics. The judges' account of the defence in #barwagarba shows it used to twist the knife in blaming the nurse.pic.twitter.com/mO4bwETQeo

It’s not doing the LP is the issue. But a septic baby (only reason we’d be doing an LP acutely) would take me at least an hour to see (history, assessment, iv access, LP & trying to get a urine sample). It’s shorthand again: to me, that’s obvious that it’s a sick baby = priority

What I don’t know is how you’d demonstrate how busy the unit was at any particular point. Or how many children were in the department at any one time. Or how many times you’d been called away mid-prescribing etc

1 Before a judge and jury, defendant just needs to raise the excuses as a doubt: so make the claims. Dr BG was surrounded by people, making a variety of records, who could be witnesses. The busier she was, the more eager witnesses.

2 Dr BG didn't make the (dangerous) claim "I was too busy to see Jack again" - the most severe she put it is heavily involved between 12 and 3. She said she should have seen the x-ray earlier, with no explanation for why she hadn't other than nurses hadn't told her it was there.pic.twitter.com/zxYUoj4Ukj

3 Those excusing the manslaughter failings generally just list items with no claim as to how that impacted. Eg she was doing the work of n doctors involving n wards. That would generally be the case most of the time. But so what?
