A worthy initiative. But needs to be accompanied by similar to address widespread concerns when patients are harmed. Otherwise as Ken says it may look like immunity for HCPs. Suggest you support @RobBehrens1884 in getting an inquiry which could cover both. Truth & Reconciliation.

I agree David, but the problem is 1000s of patients are being harmed, in quite subtle ways, by HCPs working in a defensive, fearful mindset due to harsh regulation - overinvestigating, overtreating, "just in case", which results in hidden harms. They are just not as visible.

Exactly Alan. The two problems are inextricably related and need to be dealt with together. Preventing prosecution or GMC sanction will not stop pts/relatives from being aggrieved over lack of candour.

Agree. We are not suggesting prosecution or sanction by regulators should never happen. But we have the equivalent of regulatory 'capital punishment' for mistakes to satisfy media under guise of 'public confidence'. It drives defensive practice, which is always bad for patients.

I'd also like to point out that public confidence is a critical element in all this. Doctors are keen to be judged by peers, rather than the public. It wasn't media, but the jury that
#BawaGarba failed to convince. She failed that test of public confidence, but MPTS know better?1 reply 0 retweets 1 like -

We are, possibly, the most over-regulated medical profession in the western world. Double/ triple jeopardy. Working in unsafe systems, where a culture of raising concerns can be career-ending. The fact we are losing UK doctors to work overseas is not by chance. Morale gone. Why?

Unsafe systems - unacceptable. Raising concerns ending careers - unacceptable. I'll help in any way I can to challenge both. But whilst I can't comment on elsewhere, I can tell you there's nothing over-regulated re UK healthcare. Regulation is as sprawling as it is non-existent.

Challenge is good to improve
#NHS but in current unsafe system honest doctors/nurses are persecuted and lose jobs. Impact on morale and recruitment is palpable, further worsening the crisis. But I have faith in patients’ perception of us. Most think we try and do a good job. IMHO2 replies 3 retweets 4 likes -

I think it's disgraceful that we have permitted an environment to develop where doctors are more afraid of telling the truth when things go wrong, than they are of lying. We need to shift that balance somehow and force out anyone who persecutes those trying to be honest. >>

The important part there is 'when things go wrong'. It's easy to find patients with a positive perception of doctors when things go well (the vast majority, we hope). But patients become far more knowledgeable when things go wrong - not many positive perceptions among that group.
