      Not about immunity and Drs are in no way above the law. MPTS tribunals have legal and lay members deciding on the fitness to practice of doctors.       A worthy initiative. But needs to be accompanied by similar to address widespread concerns when patients are harmed. Otherwise as Ken says it may look like immunity for HCPs. Suggest you support @RobBehrens1884 in getting an inquiry which could cover both. Truth & Reconciliation.

      I agree David, but the problem is 1000s of patients are being harmed, in quite subtle ways, by HCPs working in a defensive, fearful mindset due to harsh regulation - overinvestigating, overtreating, "just in case", which results in hidden harms. They are just not as visible.

      Exactly Alan. The two problems are inextricably related and need to be dealt with together. Preventing prosecution or GMC sanction will not stop pts/relatives from being aggrieved over lack of candour.

      I'm yet to be convinced that there's a valid argument for preventing prosecution or GMC sanction. Prosecutions are v rare for a reason - the legal bar is already higher for doctors as it is, imho. But candour... there's a compelling ethical, (if not legal), reason to demand that.

      Many cases are errors if judgement. Often an element of blame shifting. Most cases we have insufficient knowledge if facts to judge. Cover up is something else. Wrong. Should be criminal.

      Errors of judgement should fall under negligence in all but the rarest of cases for me. And currently do, it seems? The thing about blame shifting is there has to be blame to shift - so somebody's at fault. It's just another form of cover-up. Damage limitation for the powerful.

          Point is, ‘error’ of judgement is judgement itself, later relies on different set of information & ideas of ‘perfect decision’ with perfect information. But what of actual information in front of person at that exact time? Usually ignored in favour of what was known later.

          🤦‍♀️ That is the whole purpose of blame- to shift responsibility from one focus to another. Has very little to do with either true accountability or with effectively identifying or solving issues or problems.
