The distinction is doctors who intentionally set out to do harm and those that might do harm in the course of providing care to the best of their ability. The former should rightly be prosecuted. The latter need a more compassionate approach even if there are sanctions.

Sorry, but that's part of the myth that's built up since the
#BawaGarba propaganda machine kicked in (belatedly). GNM doesn't require intent - that would make it murder. Manslaughter charges exist to recognise just such a lack of intent where gross negligence proves to be deadly. -
#BawaGarba showed a multitude of systems failures - understaffing of Medical & Nursing staff, no supervision, no induction, a blood reporting system failure there was no accountability or corporate manslaughter charge for the trust. As the NHS squeeze worsens, will this continue? -

Many court findings have subsequently been found to be inappropriate. Her care was not as found "truly exceptionally bad" but an unsurprising result of such a flawed and unsafe system. Had she pointed that out she would have been persecuted like Dr Day and other whistleblowers.

She would have needed time and courage to whistleblow during in her double shift whilst doing the work of several people at once, you are unreasonably expecting her and others to be superhuman and in so doing making more tragedies more likely

Dr Bawa Garba was scapegoated by an unfair overstretched system. She was doing the work of several doctors. It could have been any of us in that situation that day. She escalated Jack appropriately to her consultant who neglected to review him and got off scott free. (1)

(2) doctors do not seek to be above the law, we seek a workplace environment and culture where we can practice medicine safely as we were taught; and not be doing 10 things at once and miss/forget things.

These are valid points John, and GNM will remain on statute. However: : how many NHS organisations which have caused untold patient harms (Stafford, Leicester) have faced corporate manslaughter charges? How many Medical directors referred to GMC for allowing understaffing?.

I absolutely agree re corporate manslaughter charge point Alan - not a single prosecution of a healthcare provider to my knowledge? Something's terribly wrong there, given the backdrop. But I still object to attempts to undermine GNM law on several fronts tbh. Borderline sinister

On the surface, you're right - we want the same things. But GNM laws already favour doctors over the rest of society, imho. I'm v concerned by the unrelenting attempts of some to raise the bar even further, whilst unreasonably claiming
#BawaGarba offers justification for doing so -
Government will take the easiest way out. They're already used to horrendous iatrogenic harms, from a workforce that apparently does it cheap.
