This was the story HSJ published in February which included documents casting doubt on the
@gmcuk case. Specifically the Supreme Court ruled in 2016 that criminal courts should treat the decisions of professional committees with "diffidence”https://twitter.com/ShaunLintern/status/965485674928463872 …Shaun Lintern added,

Very simply the
@gmcuk tried to argue the criminal courts had precedence over the medical tribunal for striking off#BawaGarba But the Court of Appeal judges clearly state this is wrong. Reinforces what the Supreme Court said in 2016.6 replies 12 retweets 31 likesShow this thread -

Court of Appeal says yes to this question. So the public CAN have confidence in a profession that accommodates such serious criminal convictions among their numbers... apparently. I wonder if the actual public would agree? That, I'm far less sure about.

I actually think it can-if you read judgment esp bits about varying degrees of culpability and different role of MPTS which must consider also retraining and ongoing risk and evidence this was v much a one off I think that is right outcome. Doesn’t erase GNM or role in J’s death.

Been following this case for over 9 months Kirsten & whilst I know I'm not 'the public', I am 1 member of it & prob better informed than most. All I can tell you is that I don't live far from this hospital & I'll be watching v closely where she goes next.https://twitter.com/c7rky/status/1028409578076160000?s=21 …

I can only hope this helps explain my perspective & I thank you for explaining yours. https://onedrive.live.com/view.aspx?resid=4C387C68AF784C5F!4877&ithint=file%2cdocx&app=Word&authkey=!AJ1wnW1exT0tsis …#JackAdcock#BawaGarba#IsabelAmaro1 reply 0 retweets 1 like -
Yes I know and I read your letter with interest. I don’t think there’s an easy answer but I found the CA judgment reasoning pretty compelling. If no presumption of erasure for GNM as DC accepted then must be open to MPTS to apply a lesser sanction if circs allow?

Been searching for anything remotely disrespectful in there. Nope...can't find anything. :) The danger here is that MPTS's credibility may end up in question. Many may ask exactly what it is that a doctor has to do in order to harm public confidence after this example, I suspect

nobody of course has asked the public if we are happy for a doctor convicted of a criminal offence involving harm to treat them, or even explain why they think they should. Also, we would never know. It’s all a bit subversive.
