      The question is not whether the criminal courts got it wrong but whether the MPTS could have gone beyond it in considering fitness to practice and sanction (i am very much generalising the arguments here)

      Thanks Kirsten. There are several issues all around the case. The latest appeal is just about the role of the MPTS and GMC, yes, but can not deny the controversy surrounding the GNM conviction also. Await to see what happens with that...

      Let me start with your last point first: Yes, it *is* GNM. Unless you're elevating your own opinion above that of the High Court, of course? And all w/o the benefit of access to the evidence presented to that court. Bear in mind her conviction is not being appealed. Only erasure.

      Far too many are lobbing evidence out of the window to cram anecdotes into a 'not guilty' narrative. So grim for Jack's family.

      It's only evidence based when it suits, apparently? Miscarriage of justice is the other phrase that's been setting my teeth grinding recently. Poor Nicky Adcock must feel battered by it all.

          We're also dealing here with incomplete evidence. There is a genuine problem if the Coroner found a diagnosis, e.g. endocarditis on the heart values, if the Doctor at no stage suspected, examined for, investigated or managed, even though Jack was at risk of it +++

          There are never any ‘winners’ in these circumstances. But do multiple court cases and appearances, media coverage, etc ever truly bring rest? Even when it is truly the best court outcome, never brings back the loved ones lost, the lives hurt forever...

          Luckily for me I’ve never been personally faced with situation, so can only go on ‘imagination’, & conversations had with many many bereaved relatives. Not everyone sees it same way, but consistent theme has been ‘retribution doesnt heal wounds, just keeps more open for longer’

          No, I’m not, I was not very clear in what I wanted to say. Sorry. For many it isn’t about retribution, I get that. Without such steadfast families/advocates poor behaviours continue unchecked for longer. But is society right to assume someone must pay for the sake of the family?

          Nobody is talking about people paying. It's about accountability. And for the record, the @H_S_E judgement meant an enormous amount to us.

          Yes, the legacy of every such death should be reduced risk for patients that follow. But it rarely is, as learning is commonly lost because of the huge prevalence of NHS cover ups. This #learnnotblame mantra quite frankly has no credibility when clinicians constantly avoid both.
