That's an interesting list - esp considering there appears to be complete non-compliance with those guidelines in this case. Have they any weight? Is it like GMC guidelines which one is obliged to account for?

That has intent. Something required in Scots law but not in English law for prosecuting medical negligence
-
A better scenario - someone weaves through traffic at 200mph, breaks don’t work, car is deficient, they attempt some preventative action although the speed makes the action less effective and still cause a pile up are their actions criminally reckless
-
I was going to reply with something along those lines, but you beat me to it. :) Key point for me is that it's possible to be personally grossly negligent in one's own actions, regardless of any exacerbating flaws around them. Which is what the courts decided.
-
In Scotland without intent to do harm there wouldn’t be a prosecution for healthcare staff. There are long lists of medics who have been criminally convicted for their wilful & reckless behaviour. The medical community stands behind Dr BG for a reason
-
Yes, self preservation.
-
No. Intent. Take it out of healthcare and apply to all those within the criminal justice system. We place our belief in a fair judicial system and try to minimise any miscarriages if justice. Self-preservation applies to all of us under these circumstances
-
All of the healthcare workers with a cold & complete disregard for the bereaved families. The level of care & attention jack received was appalling. If every conviction is challenges as being 'wrong' the
#nhs will face a very public revolt by us service users! -
That’s not a criminal offence though or a lot more of the general public would carry convictions. Healthcare staff are first and foremost citizen and the law applies equally to all

Yes but I strongly suspect Dr
#BawaGarba is the equivalent of a Nissan Micra driver who always goes at 28mph in a 30mph limit and was pushed out into a Stock Car race without a safety belt or helmet .... -
Spot on.
#Scapegoated for systems failure and failure of#Armchair Consultant@gmcuk @claremarx. This is what GMC barrister argued@DrMQureshi@sbattrawden@TheDA_UK -
I'm sorry, but the 'systems' do not explain away the lack of care & attention that jack received that day!

What she said.
