I am not a lawyer, but my sense is that the law treats threats to life more seriously than threats to property, so storming an occupied building chanting your intent to hang one of the occupants might more readily trigger deadly force than looting an unoccupied one.
Though you will find I am not fond of looting or property destruction either.
And we wouldn't want to legally elevate politicians above people running businesses or defending their property.
