I don’t know that I have ever seen sitting Supreme Court question the legitimacy of their own court before. But this decision based on partisan political outcomes rather than law strikes at the very foundation of our constitutional government.

It’s also a disappointing setback for those of us who believe in the possibility of bipartisanship. When everything is a political prize to be won or lost based on partisanship, it drives both sides to further extremes and alienates people from their government.

Brent, this is an honest question: If Republicans are absolutely against partisan judges, why is every conservative so happy about Justice Gorsuch? Obviously a different court but doesn't every admin try and stack courts with "their guys"?

I don’t have a problem with judges having a party preference. I just expect them to sublimate that to the constitution, the rule of law and fundamental democratic concepts. That’s not what happened here.

Haven't read the decision yet, but for what it's worth, the founding fathers are the ones who "embroiled the courts in separaration of powers" decisions. That's been true since day one.
