No the Benn act says he must ask for an extension if there is No Deal. There is a deal whether or not Parliament votes for it. If Parliament votes it down it is voting to leave with No Deal

At the very least the attorney-general, advocate-general and lord chancellor will have to resign. They probably won't be alone.
