        as much as we would like to believe that Lincoln did this out of patriotism, such was not the case. The Senate was in recess and he had no opportunity to nominate anyone before the election date.

        This is misplaced. Lincoln could have nominated someone even while the Senate was in recess. The Senate must advise and consent. That has nothing to do with the President's duty to nominate someone.
