        The difference, though, looking at it- Breyer concurred with the ruling (In favor of Jones). From Kavanaugh’s previous opinions, he would side with the President nominating him.

        That wasn’t the question - the question was did he recuse himself and he didn’t (Breyer also was appointed at a time when Clinton was under investigation by the Whitewater special prosecutor)

        Agreed. I just don’t think it was viewed the same. Kavanaugh was selected (from the Federal Society’s list) because of his opinions concerning Presidential exposure. That wasn’t a concern when Breyer was nominated (Seeing as how he ended up in concurrence against Clinton, esp)

        Simply being appointed by the president isn't one of them (Nixon appointees ruled against him too and didn't recuse themselves).

        Even if he is asked, he won't answer. And Senator Grassley has already given him the "out" by saying he shouldn't comment on anything that is relevant to the current members of the legislature.
