One of the main differences in employee and contractor is who sets the schedule of work hours. Uber drivers drive whenever they want. Therefore, they are definitely contractors.

Ummmmm..... They get to pick and choose when they work, or if they even work at all. They provide themselves their own vehicles, insurance, maintenance and all other overhead. They report to absolutely no boss. This is the exact definition of a 1099.

Bernie, Uber sets the rules of employment. No one is forcing the drivers to work for Uber. It is a voluntary transaction.

That would be catastrophic to a business that is positively effecting people’s lives and stimulating our economy. Work comp would be mandatory on all driver/owner-operators. All you are doing is accelerating autonomous vehicles which will result in drivers being jobless.
