Amazing that Labor, which claimed it had no citizenship issues in its ranks, is trying to refer Dutton to the HC over a non-issue about payments TO PARENTS that end up at his wife's childcare centres. If that's enough to stop you being in public life, we should all give up.

Bernard, the payments now go directly to the child care centres thanks to decisions made by the government which Peter is part of. Whether stupid or not it deserves being tested in the court

S44 rules don't apply to spouses. Dutton's problem is he is a financial beneficiary of the trust that owns the centres. He could be removed as a potential trust beneficiary, but that would only fix the problem going forward.

Um, Bernard: Dutton faces same s44 conflict for same reasons as disqualified Bob Day. Per @hughriminton today, Dutton's legal advice is based on OLD childcare payment system - not current. Time to refer the matter to the High Court. Anything less = Coalition corruption.

A non-issue Bernard? WTF? Dutton is a recipiesnt of the family trust where millions of tax payers dollars go. It is the current law of this land, regardless of ypur thpughts on the law. PS how come.ypu don't mention Joyce, alexander and the alleged 6-8 other Lib pollies #auspol

Amazing that you can’t see the conflict of interest of an MP directly benefiting from government policy re subsidies to his for profit businesses. Government payments to parents directly impact the ability to set fees, which Dutton profits from.

Actually, my understanding was that the system was changed to give the payment directly to the provider and not the family. Perhaps that’s where the issue is??

Labor had legal advice that the MP's had done the right thing. Remember Turnbull thought that Joyce, who hadn't even bothered to check was validly elected. And given Dutton's legal advice was out of date, a referral to the HC is reasonable.

Labor said they had legal advice that their MPs were eligible but the HC overruled. Dutton also says he has legal advice that he's ok so let it be tested in the HC. It's nonsense that a prospective PM could have this hanging over his head.

Also, there are other LNP MPs whose citizenship is questionable but they were never referred - no surprise there.

should be up to the HC to decide. If you you think it's too strict, you should push for a change to the constitution.

Dutton's lawyer works in property and construction law (probably the firm his dad the builder uses), not constitutional law.
