1/n Pre-charge bail consultation - why the fuss? The presumption against use of bail to go, which is fine. However, this does NOT mean the end of RUI. The police will decide on a 'risks based approach' who is bailed and who is RUId

The criminal bar has welcomed the thousands of extra Crown court sitting days announced by the government this week but says it is not even close to what is needed...

I represented a client in a trial this week where I am certain that we secured her acquittal because she had to pay privately. The defence team had to spend hours seeking and dealing with disclosure before trial. We examined every aspect of the case I detail & because of this -1

The delays in the justice system are often hard to comprehend: June 2017, fraud discovered. Culprit holds his hands up immediately. Feb '18, police get in touch, he admits everything again. Nov '19, charged and pleads guilty at court. Two-and-a-half years waiting for justice

Waiting on a verdict. Counsel in follow on trial also waiting on our jury, before they can start theirs. Insufficient jury pool so they need ours. Reading has 8 courts, 3 have trials, others are lists or not sitting. On a Tuesday, how can they run out of jurors?

Paranoid, vain, churlish and brooding – Boris Johnson is the precise opposite of his cheery public persona. Me in on a prime minister who threatens our freedoms

Lawyers will be familiar with the examples of the delays and appalling case listings highlighted in this Monday Message. For non-lawyers, did you ever think that you were living in a country where the witnesses and victims in serious crimes were treated so badly?

Slightly bemused, the judge describes the situation as “quite remarkable”. The language from the barristers whose trials have been adjourned is slightly less judicial. Swindon Crown Court is in the Lord Chancellor’s constituency.

Another one of those ‘U Wot M8?’ moments... It now looks like Swindon Crown Court isn’t sitting until Friday. Both judges are away and HMCTS seems to have decided we don’t need a Recorder. One judge tells the court he was informed on Friday (yes - Friday) no one was available.

And I say this in full recognition of the fact that, if reported accurately, this was not technically a burglary. be damned, The Hamburglar was robbed.

That they chose “McMillions” as a title over “The Hamburglar” is a sign of a society that has simply stopped trying.

A mature and responsible government enacts emergency retroactive legislation as a last resort, after sober reflection and with a heavy heart. The gleeful relish of this announcement - LOOK HOW TOUGH WE ARE! - encapsulates the ghoulish populism of the Ministry of Justice.

This, worryingly, appears to be the playbook. Act on the fringes of lawfulness, deliberately provoke legal challenge, use opportunity to spread propaganda about “biased courts” and “politicised judges”. Every day this government tugs at a thread of the rule of law.

And worth remembering that, until he started his populist and lie-fuelled leadership campaign in the summer, Johnson had never uttered a word in Parliament about this apparently obvious scandal, as I wrote here:

Some facts: 1. Amman grew up and was radicalised while Johnson’s party was in govt 2. Amman was sentenced under legislation in force while Johnson’s party was in govt 3. Amman was imprisoned and “rehabilitated” in prisons whose budget was cut by 40% by Johnson’s party in govt

This is the point that the government would rather pretend isn’t true. It doesn’t matter if you’re keeping people inside for an extra 1, 5, 10 or 20 years if they’re going to come out unreformed and just as, if not even more, dangerous.
