    Here's the brief and I filed today on behalf of 16 scholars who've spent as many as 30 years showing the connection between anti-LGBT discrimination & gender stereotyping. Huge thanks to ' Mitch Reich & Tom Schmidt who are amazing.

    I mean, Calabresi and Justice Ginsburg both started in their current jobs in 1994, but Guido has 42 clerks in academia and she has 29. That's what makes these numbers so shocking to me.

    It's not a shocker that Calabresi would be high on the list, but the numbers here are still pretty shocking to me. Guido hasn't even had 100 clerks yet, and 42 are in academia? I mean, all three of us from my year are, but still...

    Here's a viewpoint: legal scholarship is best expressed through haiku or mime, not law review articles. If I express that viewpoint in my job applications, I almost certainly won't get a job in a U.S. law school. Unconstitutional viewpoint discrimination? Give me a break.

    The vast majority of faculty searches at UC consider research, teaching & diversity statements in a holistic way. But some searches focus more on teaching experience or demonstrated interest in teaching innovation. How is experience/interest in promoting diversity different?

    But to say that those pushing other hiring priorities and funding--those who view the university's mission & needs differently--are acting unconstitutionally is strange, for it undermines the very notion that we as academics should be/must be setting such priorities when we hire

    Colleagues in the Math Dept might not think they have a need to hire faculty able to address the needs of underrepresented minorities. They certainly have the academic freedom to push for hiring priorities & funding that better reflect those views

    We frequently hire, say, clinical colleagues who have to demonstrate how their interests and experience show a commitment to helping folks get asylum, better prison conditions, or protection from domestic violence. Is that also viewpoint discrimination?

    I'd like to hear why the former search is unconstitutional viewpoint discrimination and the latter is just normal faculty hiring, done (as always) with a view toward a school or department's current substantive needs. /3
