Dr. Gawande, you are TERRIFIC! I thought I'd read all your popular literature writing, but missed this. My dad was a successful plaintiffs' lawyer; I watched him lose two medical malpractice cases. Your treatment of the topic is spot-on and fair minded, as always. 1/2
I recall story fr Checklist Manifesto where you'd slipped & cut big artery. (Caught my eye becuz I was then myself being worked up for adrenal adenoma, lol) I recall vividly that you applied this lesson & leveled with the guy after, not shut him off. You're wise saint! 2/2

Starting with your McAllen Texas story, my intro, I told people "He speaks of "we" not "they." It adds fairness & compassion. He seems to me to be on a higher spiritual plane than most." Yet again!

Excellent article! We are all only human. There must be a better way.
Thank you once again for your thoughtful treatment of a very complicated and nuanced situation without easy answers. Maybe start with addressing the situation today where basically anyone can sue anybody for anything, no matter how absurd.
I have always valued your writing! Thank you for being a centering voice.
Malpractice is one dimension, but I'll poke at the broad question. Is ANY incentive in American healthcare aligned with patients and outcomes, or do patients just get lucky because well-intentioned people decide to go into (and stay in) medicine despite the systems & incentives?
