This is an indication that it may be an activist element within the judiciary that took the initiative on this rather than the gov't itself.

No; the rumours of the second warrant was prior to Gül's denial and his denial was "bildiğim kadarıyla yok" type of wording.

I genuinely think the Minister of Justice Gül did not know.

Gul makes word play, he said "there is not decision to custoy" ; then we understood that he is summoned for interrogation.

Yes, technically Gul is right, but the subject person can be referred to court for arrest after interrogated by prosecutor.
