Bruen’s discussion of analogies is endlessly frustrating. Using analogical reasoning in a common law system—to decide if case A extends to the present facts—is just fundamentally different in kind from asking whether historical law X is “similar enough” to a background check req.

In addition: 1st opinions are usually unanimous ones. Might we have fewer with this divided court? Did the emergency docket filings distract opinion writing? Roberts said last summer he is hopeful to return to normal. But what is "normal" anymore? 4/5

For one, Justice Ginsburg is no longer on the bench. She was very speedy and often penned the first opinion. But we also learned last week that Chief Justice Roberts has launched a "comprehensive review of the Court's document security protocol." that likely played a role. 3/5

The Fifth Circuit has just set oral argument--for March 8--on the case brought by Louisiana and other states challenging the Biden administration's effort to end Title 42. And, don't forget on March 1 the SCOTUS will hear the challenge by AZ & other states to keep T42 in place.

* Reminder * No SCOTUS opinions today. We are looking at the longest time the Court has ever taken between oral argument and issuing it's first opinion. The first argument was on Oct. 3, 2022. Now we're 106 days into the term. The longest it has taken previously is 65 days.

One possibility: The court has decided not to issue opinions on argument days since those sessions are already going extra-long. If that's the case, we could see a big batch on the court's non-argument session Jan. 23.
