    Sometimes proof is not enough.

  2. Pew: Most Democrats in the U.S. (71%) do not use Twitter at all. Those Democrats say they are less liberal than those who are on Twitter, and their preferred candidates differ a bit (although national polling is not very reliable at this stage).

  3. House Democrats might have rebutted this by *including* the other earlier alleged grounds for impeachment in this case -- like arguing 'yes we were right then and this impeachment *is* also about that earlier obstruction' etc, but they went for the 'narrow' case.

  4. Jay Sekulow deploys a compelling exhibit in his closing argument: Video evidence of House Dems backing impeachment *before* Ukraine plot was exposed This goes to the (political & legal) accusation that the House was out to get him apart from the facts it found in its probe

  5. So 44% of Democrats currently expect Trump to win re-election; compared to 36% in summer 2016; which fell to just 29% in the last polls before the Nov 2016 election. (2/2; Pew: )

  6. As the 2020 primary begins: More Democrats currently expect Trump to win the election than they did *at any point* in 2016 -- but, interestingly, the wide expectation that he can or will win could drive more Dem turnout than the 2016 expectation he would lose. 1/2

  7. WH lawyer Philbin now bearing down on the House's fast timetable for getting to an article on obstruction of Congress -- this is an argument with some Constitutional merit, and which may appeal to (a small number of) Senate Democrats.

  8. And you thought the impeachment trial gave Hamilton more exposure...

  9. For politicos/many Iowa insiders, the countdown to caucus day can be dominated by results of the DMR poll, & the "momentum" it gives candidates (like it showed Obama's 08 rise) With no final poll this year, it's great to have more (perceived) uncertainty, maybe more open minds?

  10. Legally, they may feel those arguments are still compelling to some other senators -- or they feel that having made that case, echoing Trump's own denials, they have to stick to it

  11. Note in closing argument now: Trump lawyers are reiterating factual defenses that have now been rejected by some GOP senators -- who say Trump *did* do it, and they plan to acquit on other grounds.

Today the Senate reconvenes the first impeachment trial in its history without any witnesses.

  13. This satire makes a larger legal point - no legitimate investigation determines a suspect is *guilty* of one thing and then stops in the middle like 'job done.' : "The president was so innocent (or guilty) that the senate didn’t feel they needed witnesses.."

But but but I was told the president was so innocent (or guilty) that the senate didn’t feel they needed witnesses or evidence.

  15. This impeachment process began with the defendant complaining it was a sham. It ends with the prosecutors complaining it is a sham, because the defendant demanded Senate Republicans make it one.

  16. Today the Senate reconvenes the 1st presidential impeachment trial in history without actual deliberations Instead of senators formally meeting to deliberate together - like other impeachments & every other jury trial - they are nixing that, doing some speeches, and then voting.

Historically a vote for the Senate to deliberate *publicly* on the verdict requires a super majority. Interesting that may now be in play tonight.

Now: Senate votes to any fact-finding in the Trump trial — subpoenas for documents, witnesses, evidence Republicans blocking testimony from any people who were there, or merely subpoenaing Bolton’s manuscript. Bolton’s literary editors have more info on this than the US Senate
