But locking a person in a cage for decades for distributing a plant is? There are 5k plus federal criminal statutes with penalties carrying loss of liberty, most of which are predicated upon a broad expansion of commerce clause jurisprudence. Now, that isn't conservative.

So your point is that the American justice system, devised and run by fallible human beings, isn't perfect? Not exactly a revolutionary insight. I agree, but I think there's a strong argument that trial by jury is the fairest system yet devised to deal with crime.

Innocent people are arrested and even convicted routinely. Maybe conservativism, which claims to be skeptical of the power vested in government agencies, could stand to be a little more skeptical of the parts that kill and imprison people? Just a thought.
