        Think of the granting of citizenship to the children of illegal aliens as an illegal executive action that was regularized just like the illegal DACA grant of a right to work. It has been illegal for decades and we will just stop acting illegally.

        But the law and history don’t. For 106 years or so there was no “birthright citizenship” for children born to foreigners because Congress had not yet regulated immigration. With the 14th A in 1868 the citizenship of ex-slaves and their children was secured.

        Immigration was not regulated until the Chinese Exclusion Act of 1882, and the notion of birthright citizenship accruing to the children born here of foreigners lawfully here wasn’t affirmed until 1898 in the case US v. Wong Kim Ark.

        But neither Congress nor the courts have taken action to extend that right to children of foreigners *not* here legally (illegal aliens), that practice started in the 1980s as a non-statutory, non-regulatory *interpretation* of the 14th A by the Secretary of State.

        Essentially it’s merely been the practice of INS to grant citizenship to “anchor babies” based on an aside by a SC Justice and an executive decision by succeeding Presidents not to overrule the Secretary of State’s interpretation.

        As such it is clearly within the executive power of the President to overrule that interpretation and return our policy to the status quo ante pre-1980. Which is what Trump is doing. It will certainly be challenged and end up in the SCOTUS, which is where it needs to go.

        It hasn’t been ruled on since 1898, and that decision was very controversial. So I agree with you that it is time to take another look at this. But I have no idea how SCOTUS will decide.
